graffiti criminal mischief

What is the name of your state? Indiana
over thanksgiving, 2006 my son was arrested for criminal mischief = graffiti. on december 21st, my son pleaded not guilty and requested a public defender. he was accused of one count of criminal mischief . Prior to the initial hearing, a detective (small city in indiana) working on the case indicates that my son may be charged with several counts of criminal mischief in which the charges would change to a felony as damages may be over $2,500. Can the city change the number of accounts after the initial hearing?


At the time of his arrest, his cellphone and camera were taken in as evidence (along with some spray cans - hey, you can not divorce your kid!) My son requested that the cellphone and camera be returned after the initial hearing. He was advised that the case is ongoing so they will not release the camera and cellphone. Is this correct?

The charges can be changed to reflect whatever the Prosecutor can prove at trial (all the way up to trial, the Prosecutor can add or change charges).

...until the case is resolved, the police can hold evidence on file (did yoyo take any pictures of his artwork with his camera or cellphone ?)

That's a charge that Judges hate. Hopefully, yoyo can get graffiti removal as community service & restitution.

It gets expensive removing the paint.
