Grandfather (Tenant)dies grandson stays

What is the name of your state? KENTUCKY
In Nov 2004 my tenant (the Grandfather) passed away. The Grandson was living in the house to care for the Grandfather. Upon the death of the tenant which was in the middle of the Nov. the grandson stayed in the home.

The last week of Nov 2004 the Grandson asked if he could stay in the home 1 month and would pay rent.
On Dec 3,2004 Grandson gave a bad check of $675.00 and a letter of intentions of moving by Jan 1,2005,.

On Dec 5,2004 I went to home and told Grandson of badcheck and that he had to leave the premises.

I called police to help remove Grandson on Criminal Tresspassing due to no lease and he could only stay if he paid the rent. Police officer confirmed that he could remove Grandson under those reasons. Grandson pleaded to stay due to 6month old son being ill and had no where to go on short notice. Option to Grandson is to have cash within 24 hours or I would return with police and have him removed. I received cash the next day from his aunt.

Now Jan 1,2005 is here and he called to ask if he could stay another month because the weather is so bad. He says he will have cash. Still no lease or contract, no meeting of the minds, but if he does not pay do I have a legal reason under Criminal Tresspassing to have him removed immediately? He also has 3 warrants for bad checks.

**A: read the L/T law. The nonpayment of rent is a civil matter and you would have to file for eviction. He is a holdover m/m tenant.
