Grandma has custody & uncooperative on visits

5 yrs ago I had to take kids from dau & her husb as they were on drugs & unfit parents. While I was against my ex taking them, family pressures finally overcame me & I gave in. Now, my daughter is still worthless, on drugs & no jobs either her or her present husband. Criminal records are lengthy for them while the father now lives with me, working full time on 3 yr job, pays bills, pays me rent, and pays child support. The problem is my ex keeps failing to let the father see kids if our daughter comes around. Worse, she won't even call to tell him they're not coming when expected. There are no set visitation rules, and she doesn't want to be held to any definate rules.

I think they should return to their father's care as he has for the last 3 yrs shown responsible behavior. Since I live with him I know he has cleaned up his act. But, my ex holds all the power.

What can we do? Can we force visitation scheduling? Or what might be necessary to regain custody by father?

OK, you and your X took custody or guardianship from your daughter and her husband. Then your X convinced you to turn the kids over to them.

Your daughter left her husband and continued on her way with drugs and illegal activities and married a new husband- and is still an unfit mother.

The father of the children (your X son in law) has cleaned up his act for the last 3 years and now has a hard time visiting the children who live with your X.

Did YOUR X ever get custody through the court? If so, did it designate any visitation to the father of the children?

The father (either way) has the Right to petition the courts to regain custody of his children.

I agree with your X not to let the children's mother around them if she is as bad as you say. :cool:

My ex has full custody alone. The problem is there are no set rules for visitation except no overnight stays with either, which she has violated repeatedly on both parents. Our problem is that when my daughter comes into town, my ex suddenly gets in evil mode and doesn't let the kids see their father... often when expected she just doesn't show, not even a call to let anyone know they're not coming. The father lives with me, so overnights should not be a consideration since they can stay with me and he just happens to live here. But the Mother, crack-head and thief who even bilked me out of over $40000.00 in forged checks goes to my ex's house to stay and isn't even required to take a job and pay any support.

Maybe I should be asking how to go about petitioning the court to establish rules since my ex isn't performing satisfactorily as custodian.

I think a consult with an attorney is probably in order.
