What is the name of your state?DE

I have had custody of my granddaughter for 3 years, she is now 6. Her mother(my daughter) and father both signed over custody of her and I have legal papers to prove this. When i took custody, she was very underdeveloped both physically and mentally. Her parents were drug users and I believe the father was violent.

Anyway she left him and has barely been involved in her daughters life. I let her come visit when she could. 3 days after Christmas the state police come to my door with an Ex Parte Protection from Abuse. Apparently her Mother went to family court and told them my granddaughter was in danger. She told them I beat her, that she was deathly afraid of me and also that I had an illegal firearm in the house. The police took my grandaughter from a home of 3 years and gave her right back to her mother. The cops searched my home and found nothing of course.

Anyway i went to the hearing 2 weeks later and the judge found that there was no evidence to support thier claims.

OK, I went to PA to get my grandaughter back and went to the police station. They said they can't honor DE custody papers. They would need the parents to OK it. This is ridiculous. I have legal custody, how do i get her back?? I think they are even hiding out at this point. PLEASE HELP!!

You need to go to court in PA and have the DE orders domesticated. Then, with those orders from the PA courts, file kidnapping and/or parental interference charges against the parents.

That is just terrible, and by what you have said it sounds like this child needs to be with you, and that the real danger would be "child with mother". I do not have much advice on how to get the child back, but read your thread and couldn't help but offer my sympathy and understand as well as luck to you. People here will hopefully have some good advice for you.
Is the legal papers stating you have full custody from the courts themselves. If so, I as wondering if that is the case.... would the mother be kidnapping the child..... ANYONE! Good luck!

I know in the meantime they are going to come down here and just try to get custody of her back. Don't they have to give her back once that PFA was dropped?

No, not in Pa, which has already told you they do not recognize the Custody order from Delaware.

You need an attorney in Pa to file the petition to domesticate the order. Then, when the court approves, it will be the same as if the order were issued by the PA courts.

Could I just file this myself? How long will it take? And what if they just take off and i don't know where they are? They might be living in NJ with her new BF parents.

Technically I have custody, if she doesnt return her, isn't that kidnapping? I mean everything she said to get that Ex Parte PFA was a lie...and yet she still prevails..Something doesn't seem right.
