My grandson will die if visits continue
________________________________________
What is the name of your state (only U.S. law)? NY
Trying for a BRIEF history (not so easy) of only pertinant facts:
My daughter has fought with her ex-bf's MOTHER for custody of their 2 sons for 14yrs. Dad is out of the picture since 2001.
In 2001, my daughter lost custody to the FATHER b/c of false allegations... false statements his MOTHER made up & testified to. The father (unknown to us) had the boys move in with his mom! Then, he was gone. Since his Mom had the boys, NO CHILD SUPPORT!
2/08, my daughter FINALLY regained custody. LONG, entangled, SAD story.
8/08 grandma filed another Petition, 30+ false allegations. I proved them wrong, it was dismissed, she refiled a Petition saying her visitation was denied (untrue). Again, I had documentation, BUT, was not heard. My younger grandson was born with a heart defect. SO WAS THE JUDGE'S. The Judge heard HERESAY from the other Grandma that my daughter was not taking proper care of him. Grandma presented herself as this sweet, little old lady, previously a nurse who only had the child's HEALTH in mind. Not mentioning he was due to receive SSI & what she THOUGHT was going to be a large sum for backpay!!!
2009, my older grandson (age 13) refuses to see that Grandma b/c he catches on to her antics (I put it nicely). Suddenly, while Grandma ONLY wanted HIM, the 1st born all these years, she's fighting for the one (age 10) she always said was "defective"! SHE NEVER ASKED TO VISIT WITH HIM!
Judge rules for LIBERAL visitation, no trial, no hearing my daughters evidence. She claims this is for his HEALTH, my daughter is irresponsible. When the doctor reports come in saying that my Grandson's Coumadin levels have been GOOD, no problems, the Judge declares that Grandma should still get LIBERAL visitation b/c my daughter has a "blended" family of 6 boys & this would give her a break.... WTH??? Grandma's lies meant NOTHING?
EACH hearing, the Grandma is granted MORE visitation. The Judge even threatened that unless my daughter settled, she would not be against giving Grandma CUSTODY! In Feb, my daughter had *1* day with him that wasn't a school day.
My daughter appeals, wins. SAME JUDGE is going to hear it!?!? She refuses to step down. Trial not set until June, 2011. Nearly 3yrs. In March, that Judge retired, unexpectedly??? Perhaps the appeal? Perhaps that I was intending to have this investigated? New Judge needs time to review.
OK, HERE'S THE SCARY PART...
12/2010, Grandma is on the stand. She testifies she was SO SCARED b/c her Grandson told her that at his last check-up, his Coumadin level was only 1.3! My daughter must be forgetting to give him his meds! She will KILL him! When asked by her attorney what the level SHOULD be, she claims 3.5-4.5. When questioned by my daughters attorney, she repeated 3.5-4.5. He then asked if she was SURE & she said yes, SHE"S A NURSE! (She WAS a nurse, until an injury 15yrs ago, now disabled. PLUS, she had a BRAIN anuerysm LAST YR).
This disturbed me too! I checked the doctor report, his level was 1.5, not 1.3. STILL, I knew my daughter has *5* children on meds... she does NOT forget to give them meds! I began to investigate...
I knew that if the level falls BELOW the recommendation, the blood will clot, and may cause a stroke. If it is too HIGH, the patient may bleed out.
I checked online & the Coumadin level for a child with a Pace-maker should be 2.5-3.5. Just as my daughter told me. I asked my daughter to check with his doctor & have them write a statement indicating what level he should be at. Sure enough, 2.5-3.5.
While doing so, I discovered that Coumadin has a half-life of 20-60 hrs. This means that even though you may take the medication one day, it doesn't even START to work for atleast 20hrs! The level test in question was taken on a TUESDAY morning, meaning the missed dosage (or improper diet - which also affects this) would have been DURING THE WEEKEND... and guess who had him?!?!?
I got really worried then! I asked my daughter to have the doctors office send her copies of his levels as far back as possible. For the 3 years my daughter has had him back, she averaged 2.5. This was brought down by a few 1.5 & 1.7's. Surprise, surprise, these were right after a visit with Grandma!
Had Grandma purposely "set-up" my daughter by not giving him his meds while with her so that it would appear my daughter was at fault??? Who in court would even know that Coumadin has a half-life that long?
I'm NOT nuts! Reading doctor reports that SSI had rcvd, Jan, 2008 Grandma told the doctor that she was very concerned since my daughter was taking the boys to live with her. The doctor (never having even MET my daughter!) was told by Grandma to call CPS to report her! HUH? My daughter didn't even have the boys yet! BTW, Grandma has FALSELY called CPS & the Police several times herself.
THEN, I checked the averages for Grandma. I was given 2004, only a FEW 2005 (checking WHAT happened there?), 2006 & 2007. My Grandson bounced ALL over, SO MANY 1.5, 1.7, 1.9, it was SCARY!!! I found 1 appointment missed, but, what else was in the 2005??? Average for the reports I did have? 2.0. That may not seem like much to worry about, BUT IT IS as far as Coumadin goes! Plus, how many tests were given AFTER my daughter had them for a visit & that RAISED the average???
My daughter's attorney filed a Petition to have this heard prior to the trial, having the visitations STOP - at least until the trial, & was DENIED. Yet, Grandma countered with needing MORE visitation & it was GRANTED. WTH??? She has never presented *1* shread of evidence for anything.
SO NOW, my Grandson will be there EVEN MORE, she neglects him, so injury is eminent.
WHO can I contact??????
COURT - apparently doesn't care until June. Even then, Grandma always wins.
DOCTOR - I'll be having my daughter send them a request for the missing month's. Perhaps if they SEE an overall picture of the averages, they'll REALIZE, but, then, they'll be at fault too! HOW could this go on for so many years?
CPS - my daughter filed a complaint. They didn't care about the levels, they were more concerned about the documentation I had showing my Grandson was allowed on FaceBook ALL NIGHT. He joined while visiting Grandma. They told her not to let him on. His profile claimed he was 30yo, he used an alias, and he was allowed on ALL the adult sites!
PLEASE, my daughter & I have run out of options & CANNOT wait for court! While it will be a different Judge, that's not until JUNE & I dread thinking of what may happen between now & then. I've waited & waited for JUSTICE. My daughter feels she has to obey, but at what cost?!?!
