What is the name of your state?Arizona----I have a friend that is in need of some answers----They have permenite Guardianship- per court order- Now mom shows up this week and files papers Friday- Emergency Orders to regain custody of children-
In the Guardianship papers mom was to go to counciling, drug rehab, and do drug hair screening, pay childsupport - Mom took off to CA for 3 months this year with drug buddies, mom has done NOTHING above

With the Emergency Custody Papers, does the Granparents have the time to respond to them-?
Bio mom must have told her attorney that the Grandparents only have Temporary Guardianship-
The Court papers says Permentate Guardianship- Can her attorney just put what he wants to on the papers without finding out the True Records ?

Permanent Guardianship?

Your friends should consult their attorney ASAP (Today if you can find one open!). If they can't afford an attorney, (and who can anymore?), try to get help from a local Legal Aid office.

But, to respond to your question I must ask: Does your friends actually have permanent guardianship per ARS 8-871 ET SEQ.? It would so state on their original Motion for Appointment. Also, they would have had quite a bit of dealings with CPS in order to get the appointment.

If they are going to handle this without an attorney; then have them call the court house (tomorrow) to find out when the hearing is scheduled. Be there with all the court documents they have on the matter! The mom will not get the kids back if she has not fullfilled the court ordered rehab and other requirements.

The court is on the kids side! If it isn't in the best interest of the children; then mom is SOL!
The important thing is to be sure the friends are at the hearing!

Hopefully one AZ attorney has nothing better to do today and will respond with a more legal response. Hope this helps a little! (We also have permanent guardianship of two Grandkids)

Emergency custody hearings are very often heard ex parte. Your friends need to get on the stick immediately, as I am willing to bet that the hearing is tomorrow.

Don't take this personally, but it is p.e.r.ma.n.e.n.t. Permanent. Just like it sounds.

Sorry English is not my thing -

So do the Grandparents will have to show up at this too -

They got nothing about a hearing just court papers is that proper ?

They are seeing the attorney first thing tomorrow -
The Children 11, almost 12 and 10 do NOT want to go with mom at all, they said the will fight her first - She married at age 12 - divorced befor she was 22 had 2 more (twins) out of a one night stand dumped him and had another girl - She does not have her twins lost them both due to abuse - sexual when they where little .
The little girl has been abused when she was first born had to sit in her diaper soiled for days befor grandma got her. because mom had no diapers .
Mental Health has had mom with biopolar disorder that is why Grandparents have children

They are safe nothing will happen for 10 days per court policy - They hired the attorney today for 3,000.00 WOW 1000.00 for the mess for Fridays papers and 2000.00 adoptions.
