What is the name of your state?ms. but case is in ala.
does anyone know what grandparents rights are in ala?also can someone tell me how to get a judge to step down?

In order to have a full understanding of what is going on with grandparent visitation laws in AL you really need to go the the AL government website. Search the statutes for the laws on grandparent visitation rights.

The go to the judiciary section of the site and search for court opinions (case law) on the same topic. By reading the statutes, and then the case law, you will have an understanding of the situation.

However, if you also want to tell us your story, you may be able to get some advice here as well.

here goes the story

ms but case in ala.
we got custody of my husbands 3 sons july 12th,with mom agreeing to this,grandma hires atty to represent mom for an appeal,that mom didn't want.......when we got to court the judge gave visitation to mom and grandma only to be at grandmas house....the mom and the children are terrified of this woman she is controlling,and makes them all nervous,up until may she still grounded bio mom n took her car,dhs in ms has gotten involved per bio dads request,and state children are emotionally and developmentally delayed they start counseling next month for this,grandma had the 8 yr old and the 5 yr old sucking bottles,all 3 have no social skills,bottom line is we want the case moved because grandma works at the courthouse for 25 years plus we feel it is a conflict of interest
thank you for any input

You really need to try to get this moved to another venue. Unless you were asking for supervised visitation because you feel mom is unfit, grandma shouldn't have been able to get standing for visitation and it shouldn't have been ordered to take place at grandma's house.

If BOTH parents are opposed to grandma having legal visitation then it also shouldn't have been able to be ordered.

Without knowing exactly what the court orders say, its hard for me to comment more on this, but it should be fixable.

we are going to get it moved but so far the only way i have found is to wait until they have been residents of the state of ms for 6 months,bio doesn't want her mom to see the kids and didn't know of grandma's appeal so therefore the judge said she was a no show for court,bio mom is not unfit just not able to care for them as well as their dad and i....she talks to them often on the phone and we have driven 4 hours for her to see them,now she wants me to adopt them in case something should ever happen to their dad i could help her raise them....thank you so much for input........
