grandparents rights

What is the name of your state? NM

Father lives in Washington.

Mother has pleaded guilty to 4th degree felony for embezzlement. This is her second offense for this, don't know yet if there will be jail time or not. Sentencing is March 8th.

My question is mother is accusing father of abuse and not being a good father at all. Temporary custody papers state that mother has custody until such time she may be in jail and then father gets custody. Since she is making him to be unfit, can the grandparents be given custody.

I believe there's a difference between grandparents rights and them having custody. I'm not sure of all the facts, but about 4 years ago, because of a case in Washington state, it was ruled that there are no grandparents rights. Actually, it was, they couldn't force the custodial parents to allow visitation/rights to the grandparents unless it was judged to be in the best interest of the children. Where it went from there, I'm not sure.

Anyone can accuse anyone of Anything.

What would matter is if it were true, he was found to be guilty of same, and an order that changes the orig. order.

My response:

Where "it went from there" was all the way up to the United States Supreme Court, and became the "law of the land" as a result in 2000.
