My grandmother in law owns a body shop and it is right in front of my house. It was not a functioning shop until her favorite grandson quit yet another job and decided to work from home. This happens on and off all the time but it is disrupting my home. Too much traffic and not all is car related business. Can I force her to put up a privacy fence? I do believe thatthe shop lowers my property values too.
What are my rights?

My response:

Without a State name, we can't even attempt to assist you, if we're even able to assist you at all. Laws are different everywhere.

Was the shop there when you moved in? Did she assure you it was non-functional & would stay that way? Are there any zoning laws regarding body shops in your area? If the shop was idle long enough, granny may have lost any non-conforming use protection she had. Check with the city/county zoning board.

If you suspect illegal activity (drugs or chop shop), report it to the police & keep records of the amount of traffic, plate numbers, times, etc.

However, doing any of this is going to make granny spittin' mad. Why not ask her to split the cost of the fence? If she won't, just put it up yourself. After all, the fence is to protect you property values; you should pay for it.

This is not legal advice and you are not my client. Double check everything with your own attorney and your state's laws.

I am in the state of Maryland. The granny keeps on paying what ever fees there are to keep it going so I know I am screwed there but was told that because the business is affecting my household that she must put up the fence. I could get really ugly and insist that all the junk cars be removed but have resigned myself to the fact that this is going to be my life. My husband was the one that ran the body shop and he told me it was to close but granny decided otherwise so i realize I have not a leg to stand on in this matter but thanks for the input. I guess my next step is a shrink.
