What is the name of your state (only U.S. law)? Minnesotta
The following has been a very upsetting situation. More than 1.5 months ago, this terrible company of incompetence, green dot, decided to freeze my debit card account, due to the fact that my employer paid me by crediting my account, rather than direct deposit as it should be. The transaction showed up as if I had been refunded for an item purchased at the store where I work (cvs). The card company noticed that I has never made a purchase for the exact amount that I was paid, so It was a mystery to them as to why I was credited this money when I had never purchased any items adding up to this amount.
The reason why I was credited this paycheck instead of being directly deposited was because my employer (cvs pharmacy) had made several payroll mistakes, which led to me not being paid on the day that I was supposed to. I would have had to wait another two weeks to receive the payment, which I could not do, being that I live paycheck to paycheck as a young person trying to support myself.
CVS's solution to this problem was a common transaction called a "payed out" or a "cash payed out". I have always received cash in these transactions in the past which of course arose no problems with payment. This time, working at a new store, my boss (the head manager of the entire store) offered to pay me by simply swiping my card at the register, which I decided to do, because I would have deposited the cash anyways. everything seemed fine as I received the full payment to my account 2 or 3 days later. After a few hours of this money appearing in my account, the account was locked. I called green dot to try to figure it out, and they said that this form of payment is unacceptable and against green dot policy. I kept calling over the next month or so, and got many different answers. They brought my case to a review team and the final conclusion was that this transaction needed to be reversed. Another paycheck was deposited into this account also, which of course I cannot access along with whatever other money I have in there. They told me that this needed to be done by contacting cvs.
I contacted CVS HR department. Everyone I talked to was clueless as to how to reverse a transaction. The one useful bit of information that I received is that the way my boss paid me, by crediting my card, is against cvs policy. According to policy I should have been paid in cash only, during a payed out. So now both cvs and green dot have shrugged cluelessly as to how to resolve this issue. It seems as if each company is blaming the other. Nobody has treated this issue as a priority and I have come to a dead end. Now a third party must come in, because I'm not gonna let myself, an economically struggling person, get robbed by two multimillion/billion dollar corporations.
This has been going on for almost a few months now and it has made my life very difficult. It seems that CVS or my boss is at fault. The issue began because payroll messed up with paying me through direct deposit. The second mistake was the crediting of my card instead of being paid in cash, due to my boss' lack of understanding of company policy. I am writing this because I do not know what to do next. I obviously do not have money to hire an attorney to resolve this. Is there a way I can legally pursue this without council or is there another third party resource that I can turn to?
Thank you so much for reading and any advice or experience would be extremely helpful and appreciated.
