I have some friends that just got arrested for growing 10
Marijuana plants in their back yard. In their statment they addmitted too planting them. They are charged with a felony.
Is there any way they might get it reduced too a misdimeaner?

They could probably plea bargain the charge down if they agreed to turn in EVERYONE else that they know that is also growing drugs!

Other than that... my best advice (as given in another post a minute ago)...
"NEVER, EVER BEND OVER TO GET THE SOAP IN THE SHOWER!!"

You did not say what state you are in, but in most, if not all states, growing is a felony. They might be offered a plea bargain to a misdemeanor charge. Most plea bargains do not involve a requirement that you rat on your acquaintances.

Hate to tell you 'calatty', but "ratting" out your friends is one of the FIRST things asked in any plea bargain arrangements. Hell, they teach that in DA101. Let the little guys go, get the big guys. They generate a LOT more headlines!!

And it doesn't matter if they have you for a felony or a misdemeanor... either one will be pled to a lessor charge.

but what if you refuse to rat on anyone? what's left to plea bargain with?

Didn't really mean for this to become DA-101, Plea bargain school.... but,

There are several issues used in negotiating a plea bargain:
1) Offer a reduced sentence for 'other information'.
2) Offer a reduced sentence for a guilty plea (saves time and money).
3) Offer of better 'accomodations' (closer to home, etc.)
4) Offer a reduction in charges (Class 2 in lieu of Class 1, etc.)
5) Offer to drop some of multiple charges for plea.

These are by no means all the offers that could be made. And a lot of these depend on other factors (profile of case, likelihood of conviction in trial, public sentiment, suspect attitude, etc.)
