I live in Michigan and I am a long distance caregiver for my father. He has alzheimer, I do what I can do take care of my Dad. His wishes are to stay at his home for as long as his health will let him. I've had POA for 4 years now and take care of all his business( pay bills, etc)As his memory fails and all the problems that come with this disease, he forgets that I pay his bills and do all his banking, everything is sent to me in Michigan, BUT he thinks I'm stealing his money along with everybody else coming into the house and taking things, which I know is not happening, I keep very good records and files of my dads spending, or receipts if any thing needs fixing. I have caretakers coming and checking up on him.I'm afraid thru all this madness that he will try and change POA , Can he do that having alzheimers I really don't want to get gaurdianshipover my Dad. I was told that I would have to take my Dad to court, sit next to him and say he's mentally incompetent. I dont want to do this to my Dad . I was also told that I cannot be gaurdianship living out of state, is that true. What exactly does guardianship entail. Can I get this without taking my Dad to court?

Have you provided dad and other interested family members with a complete accounting? Have you done a complete inventory of dad's belongings?

Dad cannot sign a valid POA due to his dementia.

Dad will have to have doctor reports stating that he is incompetent. You cannot declare him incompetent. What's your resistance to being his guardian? You can be his guardian even though you do not reside in the same state. A person that is having such competency hearings in court does have the right to attend, and it is preferrable when the alleged incompetent can do so.
What exactly does guardianship entail. Can I get this without taking my Dad to court?
Check MI's statutes regarding guardians. You cannot do this without going to court.
