What is the name of your state? Georgia
My elderly aunt was released by her doctor and hospital into the care of my sister and I. They would not release her to go back to her home due to her health. She gave my sister and I POA over her financial and healthcare. She was unhappy living in our homes and requested that she be placed in a retirement home closer to her previous home as she missed her friends and church. We were required by the home, before they would accept her, to have extensive testing done on my aunt. During this testing we discovered that she has Dimentia. Since she has been in the home she has removed my sister and I as POA and appointed someone that she refuses to tell us. She has also done some pretty crazy things since she has been there. While we were POA we took the bulk of her money and invested it for her, leaving the balance in her checking account. The proceeds from this money is automatically deposited into her checking account, which until today bore the names of my sister and I as well as my aunt. The money was put into the names of my sister and I so that in case, down the road, she had to go on Medicare, her money would be available for any additional care she might need and would not be taken by Medicaid. Can she force us to release this money to her and what does obtaining guardianship over her entail?
