What is the name of your state (only U.S. law)? vt. I was never served papers by my ex in regards to a guardianship hearing he set for my autistic son soon to be 18. My ex did all this behind my back. When I found out the name of my son's attorney I called him and told him I never received any notification. The attorney told me this was being processed for months and confused as to why I was not at hearing on June 3rd, my name was on the list. I told him I was never notified or served. My son's attorney called the courts to let them know I was not aware of date of hearing. I received a letter from the judge yesterday and this is what it says:

"The court has been advised that you did not receive notice of the guardianship hearing concerning your son because you were in hospital. An order has issued appointing your former husband as guardian for Ryan. This order does not affect any existing schedule you may have for parent child contact."

Ummm, ok I was in hospital just last week for a couple days, so what does that have to do with being served by my ex? I don't get this logic. The hearing was June 3rd!!

So, what the judge sent me does this mean I have parent child contact forever??? Do I have any rights at all to my son? What happens to my son if my ex dies or something? I read through the order and all it is about is my ex has 100% rights to make decisions on medical, legal, education. I did not see anything on parent child contact and nothing on what happens to my son if something happens to my ex. Any advise on what I should be worried about??? ty

Since you have the order and we don't, your best bet is to have an attorney review it for and with you.

I called the courthouse. They told me I can write to the courts with my concerns. But, what is the legal wrong in my ex not serving me when it is his legal responsibility to. The courts informed me that my family court order remains in affect. I thought family court orders were good only until the child reached the age of 18 or finished high school. Does my ex having legal guardianship change my rights to him after the family court order ends? How does this affect my visitation, child support? What happens legally if my ex can't take care of him, can my ex give my son to HIS mother? ty

Seriously, you really need a consult with an attorney to review everything.
