What is the name of your state? Texas
I have a daughter that is 1 year old and her mother went to jail. I have been trying to see and get my daughter but I haven't had the greatest luck. Since the mother of my child is in jail she signed guardianship over to her sister and now the sister is moving to Washington on February 28th.
I want to get my daughter and raise her but the sister want let me get my daughter what can I do and what are my rights as the father?

Have you established paternity?
Is there a custody/visitation order in place?

I was there when my daughter was born and I signed the birth certificate. Do you I have to have a paternity test to get my daughter if my name is on the birth certificate as the father? Please help!!!!!!!!!! :(

You signed the BC -- that establishes paternity.

Did you file anything in court for custody / visitation??

If your established as father and no court order, you have as much right to the child right now as the mother. Much more rights than the aunt. You need to file now in court for custody.
