my husband has been taken to court for back child support although he has been paying. they say he owes 17,000 for last 4 years. also he changed jobs with out telling wis. child support but continued paying now they want money and possbile jail time for comtempt of court. what rights does he have and is it o.k to pay 29% of gross? shouldn't it be net. his check is less then hers more often than not.can he go to jail? how do we prove what we have been paying?

it's called receipts, receipts, receipts.

never pay the support in cash. also pay with a money order or a check and mark it as child support in the memo section. that way you have papers or receipts for the payment.

if his employer is holding out of his check, as them if they can give you a print out of their money they have held out and the dates the payments were made. most will pay with a company check, so maybe you can get a copy of the check as well.
