Gym Accident.

What is the name of your state (only U.S. law)? Texas

Hi, I was working out at a local gym this evening and when I was on a Cardiovascular machine. I accidently hit the glass wall behind. I did stop the machine before getting off but it did not do a full stop in time and unfortunately my momentum took me against the glass wall. The glass was cracked, there was also a fire alarm. My back hit the fire alarm but the alarm did not go off. I informed the staff and they filed a incident report.

Will I get in trouble of any kind? Will I have to pay for the damage?
The staff tried to contact the manager but he/she was not responding. The staff is telling me that I should be ok with no trouble. They are more concerned about my injury then the damage.

You are liable for the damage, but I wouldn't worry about it until they contact you.

If they bill you, they will expect to lose you as a customer. They may not think it's worth it.
There is also the opportunity to countersue for equipment placed in a way that could injure a user.

It is not inconceivable to think that a person would come off the machine in the way you did... but they placed it too closely to the wall.

You were not injured... therefore, you don't really have a reason to sue unless they do.

To protect yourself, I would sneak a camera phone into the gym tomorrow and get a picture of the machine, it's placement and the damage.

I accidentally broke a stretching machine at the gym, one of the handlebars broke of ( 204 pounds on it ) its a different legsplitter where u sit higher up... Clearly it was an accident but the manager wants me to pay for it.. Dont the got insurance for this kind of stuff? He called me yesterday and threatened with taking it to court if we didnt solve it now..

Biggest problem is im only here for 2 more weeks then im going back to sweden :confused:

For the love of Mike~ No one is going to sue anybody. My best suggestion would be to forget the entire episode...including having posted this here. In the unimaginable event the gym asks you to pay for the damages, you can return here with an actual issue, rather than a hypothetical.

Nothing has happened but it does not look like they have fixed the mirror.

there has to be more important things in your life than to worry about that mirror. If there isn't, find some:)


The worst that might happen is they charge you for it. If they try, personally, I would at least try the argument that their placement of the machine is the actual cause, not your actions.

then if they really want to push it, try negotiating. I would start with;

No way in hell, it was your fault, not mine. You should be offering me free membership for years to come.

all the way up to;

how often do you want me to pick up the towels in the shower room.

Just relax. Life is tough enough on it's own. Worry about things that matter and that you can have an effect on.

this isn't either one let alone both.
