I joined a gym (in New Jersey) and signed an 18 month contract with them. After joining I discovered that the facility was dirty and I never saw it being cleaned. Two months into the contract I developed ring worm (a rash passed through sweat). I went to my doctor and he wrote a note specifying that I should not go to the gym for 6 months. I thought it would be no problem to terminate my contract for medical reasons. They disagreed and are adding the missed time to the end of my contract. I am still paying monthly for something I am not using. Is there anything I can do?

My response:

You should have inspected the facilities before you signed. You could get your money back IF you can prove that the disease was contracted at their facilities.

Call the Health Department, make your complaint to them about the facility, and have the Health Department pay them a visit. Make sure you can get copies of their final reports of the facility so that you can use those reports in court.

If you can get the reports, you have a stronger chance of winning if it is shown that the disease was in their facility.
