I joined a Gym in California a couple of years ago. I really never used it but it was already paid for and when I signed up they told me it was for one year. When I signed up, the required the money up front and offered to do 3 payments with pre-dated checks. After the first month I started to recieve monthly statements saying I had late fees on checks I predated and left with them so I really thought nothing of it. Then after a year was up they start sending me bills saying I owed money for the membership for the new year. I called them and told them I only signed up for 1 year and they said they would take care of that. I kept recieving statements and called them again and this new person told me I had to send a written letter to them saying I wanted to cancel my membership. I told them that was fine but I was not paying for the new year of membership that I did not sign up for. Now I am trying to buy a house and on my credit report it shows that I was turned into a creditor and never even knew it. Is there anyway to get out of having to pay this money and getting this removed from my credit history??

Do you have a carbon copy of these checks?? As well, did those checks get cleared through the bank? If so, try and get a copy of those bank statements.

Most of those gym memberships have automatic renewal clauses in them so if you want to cancel you have to do it IN WRITING and before the contract renews for the new year.

You need to stop calling and start writing letters. Chances are you're not going to get out of this one because they're going to nail you with the lack of a written cancellation per the contract you signed. READ your contract !
