Dear Lana,

I came to US on L2 dependant visa through my spouse. I got my EAD as well.

After a year, a company sponsored H1 visa for me and i have been working on H1 till now. This visa is valid till July 2006. Due to some reasons, I am quitting my current company and applying for a H1 transfer through another company. (to hold my validitiy till July 2006).

I have got a job offer which would not sponsor H1 visa, but would allow me to work on EAD.

How long can i hold the H1 visa - if i'm working on EAD. For example, can i hold the H1 visa ideally without working till Dec 2005. :confused:

Your advice in this matter would be highly appreciated. :)

YOu cannot work on the EAD if your status has not been changed back to L-2. You must first change your status back to L-2 in order for that EAD to be valid or to apply for a new EAD on the basis of the L-2 status.

Pls let me know as to how long will it take to change status from H1 to L2.
1.Can i apply L2 myself or my spuse's company needs to apply dependant visa (L2) for me
2. If I can apply L2 myself, can i apply on premium.
3. If I apply for L2, will my H1 status be cancelled(although validity is till July 2006).

Your advice on this confused state would be highly appreciated.

Yes, you can apply for the change of status on your own; the husband's company does not have to do it. Yes, I believe you can apply using Premium Processing. Yes, once the status is changed to L-2, regardless of the validity of the H-1B approval notice, the H-1B status will cease to be valid since you can only hold one nonimmigrant status at a time.

One last question - how long does it take to get a L2 Visa. (both normal and premium processing)

Can i start working on EAD once I get acknowledgement from INS that they have received my application for L2 or do i need to wait till L2 is approved.

Having read some info in your post below, I have a few doubts, that, I trust, you can throw light on.
I am an employee of an Indian company, and shall be traveling to the USA on a project. I am going to apply for L1 Visa for myself and L2 for my wife, who shall be traveling with me as a dependent. She is 24 yrs old.
I want to know whether my wife would be eligible to work in the USA based on her L2 Visa.
Is there any additional procedure/condition that would enable her to search jobs there?
Can you possibly provide me some links to websites that can give me authenticate information.

Yes, your wife will be able to work in L-2 status, provided she applies for and obtains an EAD (employment authorization document). It usually takes about 60-90 days to receive it.

After you+ wife arrive in the US and are --admitted--, you begin your L-1/L-2 status.
Your wife may immediately go with you to the Social Security office so you can BOTH apply for your SS numbers---these are helpful for a number of things. Your wife may apply for hers using her marriage certificate and proof of your L-1 status.

Separate from that, your wife may apply for an EAD with form I-765. This application can not be sent in until she is inside3 the US as an L-2, and the permit takes about 90 days to arrive (it has been reported that the online applications take longer than the paper ones).

Shortly after the application goes in, your wife will get a letter with instructions to go to the Application Support Center to give fingerprints and a photo for her Employment Authorization Document.

She does not need an employer in advance; that is one of the nice things about the EAD--she can work anywhere she likes (you must stay with your L-1 employer).

Hi

Im on L2 visa and have a valid EAD. I was working for an indian employer before we came to the US. Im currently on leave of absence with my indian employer. Is it possible for me to resume work with the same employer in the US(they do have some projects here) while on the same visa status? Or should I be changing my status to L1? Appreciate your response.

Your EAD allows you to work for any company that will hire you.

If you go L-1, you must work for the L-1 employer only. And, you must have been their employee for the past year, and outside the US.

Make sure YOUR L-1 principle keeps his/her job and visa status current and you maintain your dependent relationship with him/her, because your EAD depends on that person.
