I received this yesterday. In the meantime, the CU wants me to make the first payment on Jan 9. If I pay that, is it some kind of technicality that holds me liable for the entire balance?

What did the attorney you spoke to say?

You potentially could set up an escrow account and hold payments in that account until the matter is resolved.
