in il / my husband applied for a job driving a forklift in a warehouse . he has done this before , has a driver's liscense , but he is low vision impaired and only has vision in one eye . he had worked as a forklift driver previously and had a safe record , he drives a car and has a safe record . the problem we ran into was that the company doctor stated he felt my husband would be a hazard to the company if they hired him to drive a forklift .
he filed a complaint with the eeoc but, they stated that
they could not find a case of discrimination through the
disabalities act . we just received a paper stating that we have 90 days to file a lawsuit if we care to pursue this case .do you suggest we pursue this matter further . i feel that he was discriminated against due to his vision and
he had preformed the job before . i could see if he had never driven a forklift . also he was forklift liscensed at the time .
