Not at all. Someone from loss control should be able to testify to the authenticity of any video used in evidence in a shoplifting case.

What can be questioned with video or photographic evidence is the reliability of the device used to produce the image (e.g., the working condition of the camera) and whether there is evidence of or the possibility of image tampering and whether what is pictured is what has been claimed to be pictured.

A photographer can testify that what is pictured is a fair and accurate representation of what the photographer saw. He is an eye witness so his testimony alone, without the photograph, is evidence.

An expert on surveillance cameras and red light cameras can testify to the reliability of the process used to capture images.

With red light camera photographs and surveillance images, you not only have the possibility of challenging the camera’s working condition but also the identity of the person pictured. In this case, however, you have a picture of an identified car parked in a handicap parking spot. The identity of the driver is not an issue. What is the issue is whether the car pictured had the required placard.
