What is the name of your state? New York

My fiance recently gave his boss a request for a status change from full time to part time as he found a better job. He and his boss got along up until that point. After, she yelled at him inf ront of a store full of irate customers that she could strangle him and told customers he would be fired for making a decision to give ithose same irate customers a free video rental. This decision calmed them down but they were apalled at how he had been treated. She belittled him in fron of customers and grabbed the phone out of his hands like a child. He needed proof of cancellation of benefits because he needed state health coverage for his 7 yr old son who threatened to commit suicide. She said in front of both of us, the HR paperwork had been done when it was not. He called HR and when she found out she was screaming at him & sticking her finger in his face. She belittled him and humiliated him. There were other incidents but it would be too long to write. She created such a hostile work environment that he could no loner work with her and walked off the job calling both Her boss and HR. She said he would be the last to get the part time hours he requested which was fine before all this happened. How long should we give HR to investigate?

Before you sue, you mean?

Considering that nothing in your post gives you a basis for a lawsuit, as long as they choose to take. The manager's behavior was appalling but that does not give you any legal recourse.

What you describe does NOT meet the legal definition of a hostile work environment. For that to happen, he has to have been subjected to either sexual harassment or illegal discrimination under Title VII (race, religion, national origin etc.)

Nothing in the law prevents a boss from being a world-class jerk.

No, we are not looking to sue but since she made so impossible to work with her, we are looking for the pay he would have received until his last day. Is there nothing that can protect employees for retaliation? She retaliated against him for finding a better job. She wanted me to find her a job the first day she worked there. She seemed jealous.

we are looking for the pay he would have received until his last day No laws require an employer to pay an employee past the last day he or she actually works. Given that no laws were broken, I seriously doubt the employer is going to offer any kind of financial settlement to your fiance if that's what you're thinking.
