I live in California. I quit a job three years ago because a fellow worker made my life at work a nightmare. This was not sexual in nature, just plain rudeness, mean-spirited, un-professional. She even clean out my desk one day because she decided she wanted to work there and basically shoved me out of the office. Our employer knew of this behavior and did nothing to stop it. She even agreed that I deserved an apology but would do nothing to help me. I did not document any instances frankly because I didn't think it would get so bad. Then when it did, it was too late. Do I now have any recourse legally? I also suspect that employer spoke ill of me when I used her name as a reference. Can you give me some advise?

I live in Louisiana, and am currently experiencing the same type of abuse. I, too , am curious about the legality of this nature. My supervisor has her own personal agenda against me, and has ignored my pleas for help, when I have been harassed by other co-workers. By my super. ignoring this issue, it has effectively given "silent approval" for the behaviior to continue. I have been subject to an extreme hostile environment for a while now. Additionally, this super. talks about her employees behind their backs, including HER manager, & Co-owner of the company. It horrifies me to think what has been said about me behind my back. I have an impeccable work record. However, she recently set me up in a knowingly hostile situation, and when I complained to her about the lack of co-operation from other worker, she re-assigned us both to different locations, and wrote up a formal disciplinary action, to go into my file, stating that I "cannot get along" with others.
I filed a formal complaint with H.R. dep't., concerning her, a few days before she took action with the mentioned complaint. I think I made the mistake of advising our General Mngr on Monday this week. (did so, only because he had been away for over 1 week & was not aware of situation).
I had told H.R.dep't. that not only did she violate company policy, but believe it to be in violation of the law. Since she took action against me, after I filed notice of harassment, ( & am sure the G.Mngr. told her), is this not in violation of the 'whistle blower' law?
Please, help. Need some good direction.

If you have a problem with a manager you need to state your problem with them first. Make sure you have a witness and document/ write down date/time and what was said between the manager and yourself. It kind of works wonders when you write down information in your your log book when you speak to these so called managers. If the problem is not resolved then go to managers boss. Next step file company grievance. If not satisfied with company grievance, contact EEOC and file a complaint. If serious enough guaranteed results.
