what a fiasco. a coworker hit on me at an after work function, to which i rejected him. less than a month later his wife began calling my work number, cell and home number accusing me of having an affair. from the moment it happened, i notified the precinct by my job and human resources. in addition, i put in a request for a restraining order against this women in the state that she lives in. i had all her messages transcribed and given to human reosurces. i had to go to therapy and i finally requested that i be moved to another position b/c the information his wife had was very detailed implying he participated a great deal to her concocted story of an affair. i was put in a VO environment for a week and was told to return to work to resume my "normal work activities". My request for a transfer was denied and the lawyers at my job are arguing that i have no grounds to make any requests. i explained i am not comfortable continuing to work on the same team with this individual. in addition, he is currently filing for divorce after only 3 mths of marriage and that they have a child together which means a relationship btw. the two will continue to exist making it hard for me to believe that this problem will go away and not arise again in the near future.

now , human resources is upset with me for pursuing a transfer and not accepting their reponse as an adequate resolution. after a month of phone calls, my number at work was finally changed. but i am still not comfortable working this man. he was allowed release form his current position before his two year requirement to receive a promotion..while my request was denied for a mere transfer ..no promotion invloved. they are also telling me that if i do get released i will have a set amount of time to find a new position, after that date i will be let go.... is there nothing i can do? EOE tells me they cannot do anything since it is not another employee... AT&T tells me the same thing...... I've hired a lawyer but he says i have no grounds... so now I'm poor and on my own.lol. does anyone have any advice to give that can help????

I'm afraid I agree with the lawyer. You have no grounds to claim discrimination or bring any other type of suit.

After the one pass this co-worker made, he has not done anything further to pester you and the phone calls from the wife appear to be at an end. I can only suggest you put this unfortunate incident in the past and focus on the job at hand.

A single instance does not constitute sexual harassment except in a couple of VERY specific situations which do not appear to be the case here. That being the case, the company is not obligated to transfer you, and they have no control over the actions of his wife. The company's lawyers, your lawyer, and the EOE have told you that you have no case. I think the time has come to accept that and move on.
