What is the name of your state?iowa
I am wondering how much time that you have to file contempt of court? The reason that I am asking is that we have had some bad luck with 2 lawyers and not working for us and am thinking of doing most of the work on our own as far as a modification of visitation. Thanks!

It happened in the first week of June. I am suppose to give the ex 4 weeks notice as to when I am getting child for summer visitation and I did that. When I went to the halfway meeting place she never showed. I have proof that I was there and I told the lawyer all of this and nothing was done. I just thought that it would help me with the modification process. Unfortunately...my now ex lawyer did nothing for me in all of this time.

What proof do you have that you were there? What does your order say regarding notification (I know you said 4 weeks notice, but does it say anything about confirming dates w/CP?)? What does the order say with regards to pick-up/drop-off? Do you have proof of notification to CP? Did you file a police report when you were denied visitation?

I bought gas, had dinner, paid everything with credit card at the location. I called a police officer and he made a report.
Our court order says only a written request is necessary. I gave the 4 weeks notice giving specific dates and times that I would meet. I sent the written request certified/return and have a copy of the letter.

You aren't too late to file for contempt, however if you did nothing more to follow through on the request other than the first letter....then odds are she will get treated a bit more lightly than if you pressed the issue and did everything possible to confirm. The wording of your letter can also factor in to some extent.....ie: if anything could appear "open ended" in your letter.

My letter was written very detailed and left nothing out. I sent that letter to her and another one a week before we were to meet telling her that the plans had not changed and that I definitely would be there at the specific time and date. She definitely knew I would be there and could care less. I forgot to mention....I called her 3 times on her cell phone in the 1 hour and 15 minutes that I waited for her to meet. I have those calls on my cell phone bill too. All of the letters that I send are always sent certified/return, so I know that she got both of them.

My ex waited 6 months (5 days before CS hearing) to file a contempt against me for sons enrollment in preschool/daycare program.
It's combined with custody mod. I had filed prior, so I think there is a wide time frame.

OK Thank you for your answers. I am thinking that I am going to try and do this by myself. I have had terrible luck with lawyers! I am going to start with filing contempt charges for this (I should have done it myself earlier and the last lawyer I had just ignored everything). Wish me luck!!
