I have just started receiving child support a couple months ago for my daughter. Support that I feel that she should have been getting all along. She is now 7 and the child support had been in order since she was 1 year old. My question is, "He used to have her on his health insurance until he lost his job 4 years ago, since then he has moved to missouri and has another job and I want to know if there is anyway that I can make him liable for her health coverage again?" I do not have the means to pay for a lawyer to take him to court to do this. It was the state that finally got him to pay child support, I didn't have the means to do it myself. I'm not a greedy person, but I have struggled to raise my daughter and to get off of welfare and I think it is only right for him to help me with seeing to it that she gets what she needs. What I receive now is not even a drop in the bucket. It does not even pay for the sitter for the month, let alone for health insurance.

was there a divorce? if so, look at it and see what it says about his keeping the child on the insurance. if it does not specifically state he has to, then no you can't make him, but you can modify the order and a judge can.

check the laws of your state. they may have a law library at the local court house or web site address.

No, we were never married, therefore, no divorce, but at one time he was made to have health insurance for her. Why is it that after all this time the state of Illinois has finally went after him for child support but nothing has been done about making sure she is covered by his insurance.

Good Luck on getting Illinois child support enforcement to get anything from your ex. My mother has been after her ex husband since 1992 for C/S. He resides in Illinois, she in NJ. NJ courts have sent Illinois CSE many many many requests to garnish this mans wages. He has been at the same job since 1995, lived at the same residence since 1996, AND he files a tax return, yet the courts say they can not locate him. Sound hokey to anyone else??? My mother has given up on even trying to collect anything for my younger brothers and sister. Sorry, had to vent on my mother's behalf. I now return you to the original scheduled post.

have your mother try supportkids.com, they managed to find my x and have a lein put against his credit. he was working and still is under the table so no garnishment, but they and will help.

From FL. You must be persistant. It is a never ending pursuit, however the laws and technology are making this better. It took me 11 yrs to be given an award and an additional year to start receiving any substantial payments out of the state of CA. I understand in the state of CA. (effective this year.) have finally implemented a program that if any one applies for a job, a search is automatically done to see if the have any c.support that needs to be deducted from their pay check. In other word instead of the system having to find them, they have to find the system if they want a paycheck. Unfortunately this does not work for those that work under the table....My support has since stopped again but I am like a dog with a bone. Now if I could just get the courts to give me an award form when I requested in 1990 instead of the effective date of 1999. This to is another example of a terribly ineffective system. Poor representation in the courts. In my case it has cost me 9yrs of support I was never awarded (because of poor representation). That adds up to about $45,000+.

This is a whole other battle....

Since he's not paying for children who reside in a different state that him, it can be pursued through the Federal courts.
