I hope to receive some free advice concerning my legal situation concerning a home here in Miami, FL USA, and I figured that this would be a good place to do so... I hope for some response, because I surely need it!

My story goes like this:

About a year ago I purchased a house, a $134,000 house, even though I was a full time student and basically making no money. You must be all asking yourselves:"How did you buy the house, and why?" Well, my sister put up the money, I bought the house under my name, with my credit, for her and her husband. The reason I did this was not beacuse the have bad credit but because they are both considered foreigners and would have had to pay extra costs and such for the house. I decided to help them out, especially since their plans were to move back to the states in three months to live, and then they would somehow take over the mortgage and the title.

To hopefully try and make this story short, I will skip ahead to today. They have now decided that they are going to move to CUBA, they have been late in wiring the money for the monthly mortgage several times, and have flip-flopped several times between wanting to sell the house and wanting to rent it. They finally arrived here a week ago and since then they have made my life very, very difficult. I came to the decision that I was not willing to include their names into the title because I feel very insecure about their moving to Cuba, I was willing to sign the rental agreement stating that I would rent the house for one year, but not place them into the title since I feel that my name being the only one on the title is the only control I have over this situation. When I said this, my brother in law went crazy, threatening to kill me and cursing at me. Needless to say, communicating with them has been rather difficult because of their tempers.

It's two in the morning right now. I should be asleep because I have a final exam tomorrow morning, but instead I'm awake worrying about this matter. Unfortunately the trust between my sister, my brother-in-law and myself has not been completely demolished... It's difficult to trust someone who threatens to kill you, and your sister who stands by and lets that person threaten your life. They are now trying to pressure into making me sign them into the title, but I feel that if I do that I'll never be free from this house. The only other ultimatum they've given me is taking me to court. Obviously, I'm 20 years old, I know nothing of the legal process and I'm terrified. In other words: HELP! I really do need some advice.

Ricky Ricardo, he ain't !!

Anyway, he can blow all the smoke he wants about taking you to court. On what grounds? The house is in your name; that means, under the law, he has no claim and no standing to sue.

You know what, you can't trust them now, and since the money is theirs, sell the damn thing for whatever you can, give them the money, let them say "hello" to that Communist asshole Fidel, and good riddence.

Firstly thanks for your advice:
My only other concern is that there may be a question of fraud on the mortgage... If there is, what could be my penalties? Would my credit be doomed forever and ever? How would their verbal contract of moving to the States in 3 months hold up under a court of law...
As you can tell, I have a ton of questions!

My response:

Yes, you do. And none of your questions should be taken lightly or go unanswered. Therefore, I strongly suggest that you spend a little money and buy an hours' worth of time from an attorney (Real Property) as soon as you can.
