Aloha, And so it went-I, one of the defendants in this case, and another family, were to be sued by the Plaint. in this case, a lawyer, for the alledeged destruction of a car and the assault of his two minor children, by my minor child, along with the other Def. minor child. Quick overview- Lawyer Dad had made contact with me day after the incident, I said I would investigate, and if my son was responsible, he would pay. Other party (DEF) was immediately hostile from Day1 to Plaint. In my invest. I had questions about the truth of Plaint. claim. so before suit was ever filed I tried to inform P that I had some questions of what he said happened. Incident was 10/99, Demand letter sent 11/18/99. My contact was by phone to P before first demand letter. P never made contact before to speak about quest. I may have had. Sooooo, 12/99 P files suit against Myself, Def. Family2, and J. Does 1-20. Being Pro Se, I had no idea of what I was facing so I whipped out a letter denying all allegations and FILED it with court. After doing so I got a copy of NOLO press book,"Howto defend yourself in court" and present a winning case" This book wasa great help. Soooo, pre-hearing meetings , etc. all take place i trying to be as professional as poss. and Def2 being an ass. P just trying to distarct and confuse, manipulate ( just my view, of course), Arb. was Aug23,Aug24, 18 hours total. Some of the High (low?) lights- P tries to make contact 20 min. before arb. to ask if son (mine) is going to stick to his story of no involvement, if he is, you will lose, if he agrees with our version, you will be let go, allowing us to go after Def2 easier. My reaction was Yeah, right. No deal, 10 months of my work and now you want to talk? No. second surprise- P #1 witness, cant be found! Now to be replaced by other. why intresting, is that 1st wit. was of questionable charecter, when wit. replacement test, he has been told of the case only for the past few days, CAUSE HE IS GOING ON A MORMON MISSION- 360 opp. charecter! And Arbitrtor acknowledeged this fact. Sorry, long story short- Testimony mostly of teens- prob. cancel each other out- no independent ID of my son as to allegations,questions on validity of subeonad documents- Lawyer Dad made contact when of intrest or value to him, but not reciprocated when of no value to him... Now just wating to hear of judgement- Oh and the Def2's son and wife yelled and screamed at P on day 2 and stormed out- I also had filed a cross claim stating the suit should be between P & Def2 and Does- My view being that we were named just to help P case, and as fall guy for Def2's actions--i realize this is kinda hap hazard, but if you check my other posts maybe it will make more sense. Note to homeguru- i work with Butch and Melemai in HFD- good people- and Butch is a blast to surf with...will let all know the out come thanks to all for the advice it all helped somehow...Aloha
