For his third ticketed drunk driving event, my brother-in-law ran into a city bus with his car and injured the driver and a few passengers. He is being sued by these people who ALL turn out to be illegal immigrants, including the driver. Sense he will be in prison for a couple of years for this, shouldn't the city at least cough up enough to send these unfortunate victims back to Mexico?

so your drunk brother in law is claiming an employee of a city who is a licensed bus driver is really an illegal immigrant? Somehow this person was able to be licensed to drive a bus, undergo a background check, possibly be a member of a union, and yet be an illegal immigrant?

I work for the transit dept for a city entity and believe me they do a thorough background check (at least my city does) to verify employment eligibility among other things. We have to verify 10 years documented work history, pull MVDs, plus the driver gets fingerprinted by the police department. PLUS, being that they have to have CDL's w/passenger endorsements they also have to go through the CDL side of it. So I doubt this driver was illegal.

As for coughing up dough to send them back, I'm sure this is something the INS (yes, I know that name changed) has already done if they are actually illegal.

Someone was driving drunk and hit a bus. People on the bus were injured-why does it matter whether they were immigrants,legal or otherwise,beings from another planet, or the local chapter of Mothers Against Drunk Driving?
Maybe I'm missing something, is the drunk driving supposed to be somehow a lesser offense due to the "class" of people who were injured?
Is there an insurance issue here? Are you asking if these alleged illegal immigrants will be deported and that will absolve your bro-in-law's insurance of paying for their care? That they will be barred from filing suit.Guess what-the hospital sent their bills to the bus company, and the bus companies' insurance carrier is going to go after your bro-in-law's insurance. If he had no insurance then he is at risk for a lawsuit,and it will be the BUS COMPANY filing the suit,whether the injured bus passengers have been sent back to their country or even planet of origin.Was that the core question-"Can my bro-in-law be sued?"

Postscript- even if the city does "cough up enough money" to send the unfortunates back across the border, then they will turn around and sue your bro-in-law for the money that they spent.
Is this guy your bro-in-law by virtue of being married to your sister? Do they have joint assets? Could your sister lose those assets? I'm not an attorney but I'd be fairly comfortable saying that he could be sued on a civil matter even while in jail,and if he loses,and has no money or insurance then assets could be attached.
