If My roommate and I share a home, have children but not together, can we both file head of household?

Nope. Unless of course one of you files from 101 My Street, Anytown USA, and the other files from 101A My Street, Anytown USA. Of course that isn't entirely legal.

This is from the ca.gov site.. we are 2 families with our own children.. I would think we can but I am still not sure.

Let me put the entire CA definition so you can see the whole thing


You are keeping up your home only if you pay more than one-half the cost of keeping up the home for the year. Generally, if two or more people keep up the same home, only one of the people could pay more than half the costs and qualify for the head of household filing status. If two or more families occupy the same dwelling but maintain separate finances, and each family does not contribute to the support of the other family, each family may be treated as keeping up a separate home. The taxpayer who provides more than one-half the cost of maintaining that separate home is treated as keeping up that separate home. To determine whether you paid more than one-half the cost of keeping up your home, complete the following worksheet.

Do not include costs of clothing, education, medical treatment, vacations, life insurance, transportation, rental value of a home you own, or value of your services for those of the person qualifying you as head of household. Temporary Assistance for Needy Families (formerly Aid to Families with Dependent Children) payments you use to keep up your home do not count as amounts you

The IRS will disallow it and you'll have to fight it. Have your taxes done by a professional, if you can find one willing to take that position on a return. Also, one of you get a PO Box, and file your return with that as the address. It will make things much simpler.

Also keep in mind that the California Tax Code is not necessarily identical to the US Tax Code, and it doesn't matter what the allow in CA if you are living in FL.
