Last Sept. I was involved in a motorcycle accident. The other driver was completly at fault. I was taken to the hospital and my personal health insurance paid the initial bill.

I settled with the other drivers insurance Co. in Dec. of last year (2000). Now my health insurance Co.(which I no longer have) is threatening to take me to court to recover the bills that they paid.

After paying off the remaining bills and replacing lost property, I returned to school. Lost my job and used what little was left to support myself for awhile. I am now a broke, unemployed student.

My question is.....is there anything I can do to avoid having to come up with the $5,000 that they want. OR am I just out of luck?

What does your settlement say?

Did you settlement inculde an amount for the medical bills? They itemize all the figures.

If so then you have to pay it back, it all depends on the wording of the settlement.

Or file for bankruptcy.

My response:

It has nothing to do with "the wording of your settlement" with the other person's insurance company.

Your own insurance company is saying they are, by contract, entitled to be "reimbursed" (get their money back) from your settlement for the monies they paid on your behalf. It's called "Third Party Reimburseable Medicals". That is, when your own insurance company pays money, and then you're able to obtain money in a settlement from someone else, your insurance policy says your insurance company SHALL be entitled to get their money back from you.

Talk to the adjuster from your company, and try to negotiate a lower pay-back, and terms for monthy payments.
