My husband is supposed to provide health insurance for his 2 children as stated in his divorce paperes, And he provides full coverage, dental, vision, medical , Thier mom is not responsible for anything except maybe taking them to the DR once in a while and paying the co-pay when she takes them ( they are supposed to split any co-pays)

So my son is also on the health insurance plan her kids are on and all she does is complain, I dont like that we have only 1 eye doctor, so i printed her the list of 50 eye doctors our insurance provides, i dont like the dr they go to,,,,well she picked thier DR 6 years ago and luckily our insurance has that DR listed,
Well she wasnt impressed with the level of care her son got at the dentist when he had a tooth removed,,,,i dont know how she could make this decision as she wasnt event here to begin with,,,,anyway to make a long story short because she doesnt want her daughter ( who is 9 and pulls her hair out and cuts her self and cries all the time) in counseling she decided to cancel our insurance and provide her own,,,,,,

that would be fine except my son who has an upcoming hernia operation scheduled now has no health insurance because she called up pretending to still be married to my husband and now my son is without health insurance and she is demanding that my husband pay ALL of what she pays into insurance she chose to get . She wants him to pay the premiums and all the copays and is actually taking him back to court for this,,,,,thanks to hr my son wont have his surgery, because its going to take forever to get the insurance reinstated, Im so mad right now,,,,,,,,,,,,,,,is it legal that she did this?????

It's fraud, and interfered with your child's health coverage. I'd go after her legally, big time. Did dad go to his insurance company and ask why they allowed the coverage dropped without verification from the insurance primary?

That is WAY too crazy. I would definitely pursue that legally. My husband's insurance I don't think would ever allow me to cancel it and I'm married to him.

I would sue her and the insurance company.

I'd go at it slightly differently.

Insurance company: no need to sue them. Call them up, speak to a supervisor if necessary, and ask why the insurance was canceled. If they say that your husband cancelled it, ask for documentation. Since they won't be able to provide it, they'll have to reinstate. I doubt if it's worth the expense of suing them - especially since insurance companies tend to dig in their heels when sued.

As for her, I'd file a police report for identity theft. There probably isn't enough evidence to convict here if there was only a phone call, but you'll have the complaint on record - and maybe she'll see that she can't get away with that.

How about your husband just calls the insurance company, reinstates the insurance and password protects the account....

All of you (with the exception of maybe Misto) are prepared to fight with a crazy person and unless you're also crazy and have a bunch of time on your hands, you're spinning your wheels. I wouldn't even call the police. It's just not that serious.

I don't understand. If this is an employer-sponsored benefit, then most insurance companies require a qualifying event in order to cancel coverage, unless it happens during the renewal period. I can't imagine that an HR department would allow anyone other than the employee to cancel.

Is this Medicaid or a state-sponsored health plan for the indigent?

If it is a private plan paid for by OP's DH, then this should be an easy fix, retroactive to the day of the alleged cancellation.
