What is the name of your state (only U.S. law)? CALIFORNIA

Custodial parent has applied for Medi-Cal. I was recently notified by my employer that a dependent was added to my Health Insurance. However, my premium a week is $151 which is not reasonable. What is the quickest way to change this? How long will it take? Can custodial parent call child Support office and tell them she does not want health insurance through my employer?

Unfortunately for you, no, mom cannot do that. Whenever a custodial parent files for any state's Medicaid, the social services agency always requires that the child be put on the ncp's insurance if there is insurance available. There is just no way to get around it. You can file for a recalculation of child support to factor in the fact that you are paying for the child's health insurance, but that is really your only option.

I'm no longer paying monthly child support, only the arrears. The case cannot close until I pay off arrears. Any idea how long it takes to get a court date so the judge can change the order?

I work in employer benefits and have for some 35 years.

The ONLY reason I can think of why your employer would add a dependent to your health insurance without being directed to do so by you, is if they received a order from the court or from the state mandating that they do so. They will not remove the dependent unless the order is rescinded by the body who ordered it. Since the matter has gotten this far, unless the CP is able to show that there is already coverage in force elsewhere, the child support office will NOT rescind the order to your employer no matter what the CP asks.

How long will it take to change it? That depends on how long it takes you to find alternate coverage for the child.
