My 10 year old son had heart surgery 5 years ago and has had 2 perfect checkups after that and the cardiac surgeon and doctor have both written letters that he is now fine and in normal condition. Becasue of my stupidity, I had a lapse in payment in our company insurance and the have cancelled our company insurace as of last month. I have tried to enroll us as individuals, and they accepted the rest of us but not him. Saying that "due to their very stringent underwriting rules" they could not accept him in. They did under the group insurance and will again in August on their open enrollment date . Can I fight them? My son is fine, I have letters the say he is fine.

I'm a Northern Girl
It's been a couple of years since I left the health insurance industry but as I recall it, group insurance cannot deny an individual but individual insurance can. If that is correct, and I believe it is, you will have to wait until the open enrollment period. In the meantime, you might be able to find him a short term policy to fill the gap.
