Health insurance mess

We have had continuos health care coverage during 1999 with SunStar insurance. In February we received notice that Sunstar was in receivership and we would need to acquire new health insurance. It wasn’t until the company went to get new insurance because of Sunstars bankruptcy that we received a notice of coverage that stated our coverage had only gone through Dec. 31, 1999. We were quite upset because I had surgery during March along with several medical tests. My husband talked to the bookkeeper about the dates on the certificate. That is when we learned that his employer had chose not to pay Jan., Feb., and March’s premiums. He chose not to tell anyone except the bookkeeper. For three months we thought we had insurance and did not.

In April the company acquired new health insurance. They paid April and May premiums. This insurance company did not exclude us because we did not have continuos coverage for one year. His employer was paying for the family’s health insurance again.

My husband left the company and went to work for another company June, 1st. We acquired insurance through small group Cobra. We paid premiums for June and July. My husbands new employer started providing family health care coverage in August for us.

We received our new insurance cards around the middle of June and then about a week or ten days latter we received our membership packet. On August 3rd we received a letter from our health insurance company dated July 19, 2000 stating that they have determined not to treat any of us for any pre-existing conditions until March 31, 2001. Because we received our cards and no notice of any pre-existing clauses we did not pay Cobra payment for August.

So now we have health insurance that is not going to pay for more tests that I need and the medications that I am on. This whole insurance has been such a nightmare. It is bad enough to be sick but then to worry bout how to pay for medical bills. Is there any action we can take against the past employer because he didn’t notify us of not paying premiums? Would we have qualified for Cobra during that time? Or can we do anything because our new insurance company didn’t notify us in a timely fashion. Any suggestions would be greatly appreciated. I live in Florida.
