What is the name of your state? New York

Can you please tell me if someone who has been out on Workers' Comp, who is covered under spouse's insurance, can receive their opt-out insurance payment while they are out on comp? While this person was out on comp the company has shut their doors. He has been out since July or 2004. The company did give him January and February's (2005) payments but has refused to go back to July.

Are you talking about a bonus amount paid to you for opting out of your company's insurance and going on your spouses?

If so, then it depends entirely on your company's policy. Such an opt-out is not required under the law but is a gift from your employer.

The only thing I would add is that they cannot refuse to pay it to someone who is out on workers comp IF they would pay it to someone who was out on a non-work related medical leave.
