My divorce decree says that mother will provide health insurance for the children and parties will split any uncovered medical expenses in half. My question: Are health care premiums considered uncovered medical expenses?

In our case, no they were not (neb). They were taken off the gross income total so that the money spent on them was not figured in with income when caculating cs payments. In other words if income was 600.00 you would minus out the health insurance premium of say 50.00 and use the 550.00 as the basis for figuring support. Don't know what they do in Ohio.

There is no child support ordered. We have a shared parenting agreement and each party is supposed to share the education and uncovered healthcare expenses. I'm just very confused on whether premiums are considered uncovered healthcare expenses.

Thanks for your post.

Reverse the situation

My feeling is that health insurance premiums are a medical expense and should be reimbursed. When I had court last year, the judge also ordered my ex to reimburse his portion of the premium for the children. If you carried the insurance, would you want to be reimbursed?

You are not obligated to pay part of the insurance premiums--the mother was ordered to provide that coverage. The two of you are jointly responsible for expenses such as co-pays and those items not paid by insurance.
