In 1981 I received a pled guilty to 2nd Degree Criminal Tresspass and received a Motion for Deffered Judgement for a period of 24 months. The 24 months come to pass and since I committed no other offenses my guilty plea was witdrawn and the case dismissed with predjudice.

My question is: Must I say on a job application that I have a criminal record? Do I have to say that I was convicted? Can I not mention anything at all since the case has since been dismissed.

This happened in Colorado but I no longer reside there.

I am a law school graduate currently awaiting Bar results. What I offer to you is mere information, not to be construed as forming an attorney-client relationship.

If your case was dismissed with prejudice without having to spend any jail time prior to dismissal, it means you will not be charged again for the crime and your case was dismissed (YOU WON). Therefore, I am pretty sure when I say you do not have to show it on employment or any other application.

If you want to make sure 100%, contact your local legal aid foundation (located in the community guide section of your yellow pages) and ask a legal aid person in the criminal defense office. Also, try your local law school and ask a criminal law professor!
