I have recently signed a one year lease (2 months ago) on a townhouse. I have decided to take another job in California and I am wondering what my rights are in terms of ending my lease. My landlord said that I am responsible for paying out the entire term of the lease. In addition, there is a subleasing clause in the the lease as well. Are there any rights I have in terms of getting out of paying the entire year? The townhouse would be very easily re-rented! Please help,

Thanks

My response:

The following is a re-print of a response made by Tracey. I had no permission whatsoever from her to re-print it, and it may not reflect her current way of thinking on this subject - - but, who cares? It's just a damn good response.

Per Tracey:
"They do not have to let you out of your lease. They do have to make "every reasonable effort" to rerent your apt ASAP if you leave. If they can't rent it, you have to pay the rent. They can also charge you a "reasonable" fee to rerent the apt."

Good luck.

Do you know if there is anything legal to support the fact that the landlord has to make reasonable efforts to re-rent the place?

Please check your lease contract and tell me what Virginia Code sections are cited, and I'll look them up for you.

There are no codes cited at all. But he just called and said he is going to charge us 3 months rent-- even if he gets someone to rent it right after we leave--- i think thats illegal!

My response:

I tend to agree with you; however, because I cannot locate anything "on point" in Virgina law, you should check with a tenant's rights lawyer.
