I filed Chapter 7 back in March. I didn't get a lawyer and I filed on my own. Last month I got a letter saying my case was closed because I failed to complete the 2nd part of my credit counseling course. I thought I had a little longer but I was wrong. I did the class and went straight up to the court and tried to reopen my case as soon as I got the money. They told me to go to the website and print and fill out official form 23 and to bring that with a motion and an order to reopen my case. I searched their website hoping to find a motion and an order but there is nothing. She told me I have to write it up on my own.

I haven't got any special programs on my computer to write such a thing up. Can I write it up in wordpad or notepad or do I need a special program? I can't afford to buy anything special right now. I plan to say I just didn't have the money to complete the course. That is the truth but how should I word it? Any tips for me? What is the difference between a motion and an order to reopen my case?? I need both and I am so lost! Please give me advice!!:eek:

OR... If there is a website that you know of with the forms so I could just print them out that would be great! I have been searching google but haven't found what I need. I am sure there is something out there but I just don't know where.

I have googled like crazy and found nothing. I desperately need to find this info. Can anyone give me some direction? I honestly can't afford an attorney or I'd call one. I just need to figure out how to do these forms. Any advice would be greatly appreciated.

I'm in the same boat. Did you happen to get any info on how to word the Motion to Reopen the case from any other source yet? If you get any info pls email me at [email protected] because I would greatly appreciate any assistance I could get at this point as we already have creditors calling us again.

Unfortunately, I have gotten nowhere with this. It's very frustrating. I'll let you know if I figure it out. If you get any answers please post what you find as well!

All you need is some kind or word processing program that will allow you to properly format the Motion to Reopen, you can't just write it as a letter. You need to re-open to file the certificate AND you are going to have to pay the filing fee to re-open your case.

You can get OpenOffice, which contains tools much like Microsoft Office but OpenOffice is FREE. It's easy to install and fairly easy to use. You can get it at www.openoffice.org.

This document contains an Order to Reopen, you can copy it and change the details to fit your state and bankruptcy district details:

It also gives you plenty of information on what to do.

For Ladynred -

I'm located in Southern CA and after reading some of the info on the BK shouldn't of the court sent a 15 day notice to file Form 23 before they Closed my BK7 w/o Discharge? If so, I never recieved that notice. I would love to get that sample of the Motion to Reopen, my email address is [email protected]

I have been so confused with all this and you did send me some info previously but like I said I was confused as well as had some other issues to deal with. Thank you in advance!

Another question, do I need to include an attachment of Form 23 to the Motion to Reopen when I go file and pay the fee's?
