Hi...My husband has received a notice in writing from a debt collector stating he owes a debt for an unpaid phone bill from approximately 9-10 years ago for approximately $800.00. However, this bill was incurred for an account under his fathers name in a different state (OH). My husband and his father have the same name....he is a Jr. His father passed away in 2002. My husband did not live at the residence where this occurred. This is the second time a collection agency has contacted us about this (a different agency than the first time). We took the recommended action the first time by writing a letter explaining why my husband did not owe this money, his father was deceased, etc, etc.....we thought the matter was cleared up, yet now we are receiving notice again....in writing and also harassing him on the phone. Does anyone have any advice on how to clear this up once and for all? The bill is perfectly valid as far as I know but it was under someone's name who is now deceased. Who is liable for this if the original debtor is deceased? Shouldn't the collection agency be able to differentiate by SSN and realize that my husband is not the one who owes the bill? If anyone out there can provide any insight to this matter it would be much appreciated.....thanks!

This debt is outside the statute of limitations for your state.

Write a letter. Just say "I dispute this debt" and "cease and desist all contact". Sent the letter certified mail return receipt requested.

Be sure to include the name and address they are using. If you have their internal reference number, include that. If you have any correspondence from them, include that.

The calls should stop. If they don't, post back and I try to help you find an attorney who will warm their backsides.
