HELP, dependency hearing, restraining order!

What is the name of your state?CA

1. What form do you use to answer a petition form JV-100 for a dependency hearing? My boyfriends son is being represented and mother is a drug user, but now making false allegations against father.

2. Now mother put a temporary restraining order on father, and he owns no firearms, so how can he respond, and what form does he use? She used JV-250.

3. How to request DNA test?

He has not been able to talk to child or see him since september, mother is alienating son and telling stories that are not true. This restraining order stated father constantly is coming over and calling with threats. HE has NOT been near her home since September. How does a father protect himself when he has no money saved for an attorney? He is afraid he will lose his job over this too. Please help with forms and advice, he needs to respond.
 


Thanks, I tried all of those since I knew of the sites since I am pre-law, unfortunatley he doesn't make enough and also makes over the amount for free help. Situation really stinks, I just wish CPS and court could see that there are people who lie for revenge and this is the sad situation he is in.

If anyone knows of a good way for someone to listen, since CPS is convinced by a con artist, please let me know.

There WILL be a hearing on the custody of the children as it is required under law. You can answer at that time as well.

I hope they see through the lies at the dependency hearing. I just do not know how well they deal with the kid being moms brainwashed sidekick. I hope the court appointed attorneys are open minded.

How many court dates total should be expected in this type of case. Dependency on Jan 20th is scheduled with accusations against mom on drugs, and not taking child to school and they threw in a statement that both parents put child in the middle, how they got that I dont' know.

How many? That's impossible to say. A minimum of one - if the state returns custody and visitation to the way they were. And as many as needed. When there is little to contest, there may be as few as three, in my experience.

Without an attorney it WILL be more difficult. And if the state believes the allegations, your boyfriend may be requested to jump through a lot of hoops for CPS.

And the restraining order is another matter with another hearing - unless they are somehow part and parcel to each other.

The restraining order will be heard on the dependency date. Dependency date has been set for over three months, restraining order just popped up last week. He is just appauled that is own son would back up false allegations. Mom gives the almost 15 year old false hopes that he will "get in the money" by not seeing his dad. I'm glad I dont' do that to my son.

The child was never taken, I guess the drugs were not "serious" enough. So mom didn't like being the target and now is targeting dad.

Sadly he is ready to throw his hands up if his son doesn't want to see him, He's jumped through hoops calling, making counseling appts that son later refuses to go..only to be laughed at by the mother, son, and get false allegations.

I guess Karma will have to take care of them someway.
