What is the name of your state (only U.S. law)? Washington State

We are being evictied we have 3 kids and no where to go. We have had a rough time and cant afford to live here. I was notified of the 3 day pay or vacate by someone at the door. After we got it we tried to get ahold of her with no reply back. Now on thursday sep 25th we had a legal posting on the duplex. To be out by 10-01. We were never notified of any court date. We have no place to go but are looking at low income housing but getting out of here in 5 days we just cant. Sheriff is due out here on weds. We have kids and we will be homeless. Should of i been notified of a court date so i could have gone?? What are my options at this point. I've also called her several left several messages and shes not getting back to me. please help..

You are correct; you are entitled to respond in court to a notice to vacate (which is what your landlord has sent you).

If you do not vacate the premises by the date posted, the landlords next step would be to file in court. You will receive notification of this hearing and have a chance to respond at this hearing.

If the judge rules against you, the eviction will occur.

What reasoning would you use not to be evicted? You've already indicated that you've had a rough time and cannot afford to live there. It would appear that your landlord is seeking this action because you have failed to pay rent.

Yes it is because of failed rent. This paper that was stapled to the house said "on this court of sep 17th" its been stamped by the courts but we were NEVER notified of such court date.

You will need to contact the clerk of the court , likely in person and ask to see the file on monday while you find a land lord tenant atty who can assist you to learn further how you were served the notice. Still do prepare to move out , get the things you do not need out ASAP , even if it means storing things in a self storage locker or at a trusted friends.

TY for your responses. I called the clerks office. I was told they filed on the 17th sep next day they went in and filed default which gave us NO time to respond. I have several emails to her i have printed those out and iam awaiting a call from the despute resalutions office.
