In September of 1999 I was rented a home in Ivins, Utah. I made sure the owner knew that my handicapped mom vistied quite often.
A week after I moved in my mom was over and we went out the back door. As I turned to close the door my mom misjudged the step off of the stoop and fell. The step was the same color as the drive way and very hard to tell the difference in the sun.
My mom broke her hip and has been confined in a Nursing Home ever since. Her quality of life is pretty low but I can not physically take care of her.
If there had been a painted strip on the step or it was a different color then the driveway this never would of happened. I know I slipped off this step many times because you could not tell where the drive began unless you really looked.
Is this something that I (on mom's behalf) can sue the homeowner for?
