Hi im 16 and am in highschool. I have no criminal or disciplinary record. I realize that in the near future i will most likely get severly beaten in school. This guy is a real...well bad person for lack of another word. I am not sure whether he is 18 or not. He his going to beat the living daylights out of me because the girl he likes, likes me. I have done nothing to provoke him and he is much bigger and older than me. Since i realize that i will indeed get my booty kicked within an inch of my life i was wondering what i can do after it happens. Can i press assault charges? what sort of punishment does that bring? Can i sue for pain and suffering? I just figure since i already realize whats going to happen i should probably get a head start on the legal things. thanks any help asap would be great. Sorry if this is in the wrong forum i didnt know where to put it and i'm desperate.

If it happens at the school, notify the school officials. You can also contact the police whether it happens at the school or outside of school. For a criminal case, it won't be up to you to decide whether to file criminal charges. That will be the decision of the police. If it happens on school grounds, the school officials will decide what actions to take on their end. As for a civil suit, yes there is a cause of action if that would happen, but you are getting a little ahead of yourself.

Why not address the situation beforehand, instead of waiting for him to assault you? What leads you to believe he is going to hurt you? Threats?

Really. A prudent person would spend his energy avoiding getting beaten up, not planning what legal steps to take afterwards.

Well hes told other people he is going to (kids who want talk to administrators) and this kid is a complete nutjob. He has absolutely nothing to lose. He also has a record of fighting and i expect he wont hold back on me. I don't know what to do to stop the situation. If i talk to a teacher it will just get worse. The way it looks at the moment is that i will get pummeled and i don't know how to stop it. I was just wondering what legal action i can take if he does assault me.

Stay away from him. If he beats you up, call the cops.
