I have been trying to pay all of my credit card debt with a loan that fell through. A friend has offered to help me. I was dealing with an atty. office and they had offered me a settlement amount of $15K on a $20K balance. This is when I was told I would be receiving the money from loan within the 3 days. Well the loan fell through so was not able to pay the settlement amount. Now they have got a judgement to garnish my wages. It is still possible to offer the atty office a settlement amount and how do I go about this so that I can get this judgment closed or cancelled. Do I need to file papers proving I paid this account or does the collectors atty file papers. If I file what papers do I file. I have never had anything like this before and am completely stress and upset.
thanks

Yes, you can still negotiate, but now that they have the judgment its going to be a lot harder. They can get ALL you owe thru garnishment, bank levies and siezure of non-exempt assets. Write up a settlement offer and send it to them, don't do anything on the phone, do everything in writing. If they take your settlement, then when the judgment is paid off, ask for a letter of satisfaction and file it with the court and that will close out the judgment.
