my current husband was married back in 1986, he claims they got a divorce in 1987 but there are no documents to support that ? WHAT DO I DO ??? :confused:

i already have he states they signed papers in the judges chambers but the records are no where to be found. This is a little po dunk county in Georgia and everything was written in pencil and no computers back then. So I don't know what to do

Did you get a marriage license and get married by someone who was officially allowed to perform a marriage? If so, your marriage is "legal". It may be voidable if he did not get divorced from his prior wife, but its legal.

Why is this suddenly a problem?

I disagree. A bigamous marriage is VOID in GA, not just voidable.

However, from my understanding, even in the states where its void, you still have to go through the process of a divorce or annulment so that the marriage is clearly voided.

WRONG. If it is void it is VOID and has not existed. VOIDABLE requires a divorce or annulment. Though she could divorce him using a putative spouse argument.

Keep in mind that Georgia had common law marriage as recently as 1997. If they were living together and professing to be married before 1997, then they might still be legally married even if the original ceremonial marriage was void - if someone actually obtained a divorce before 1997.

OP needs to speak with an attorney who can search the court records to see if a divorce was ever completed.
