Hello,

Can anyone give me stepwise instructions on how to file a small claims or justice civil suit in Texas?

I need to subpeona records only. How do I do this? I know I have to start with a complaint but do not know how to write one.

The defendant's information is not known so I have to postpone service. I basically need to gather information that will allow me to prove the identity of a harasser. I need to do this before I can take any legal action against the person.

How can I do this through the Texas court system quickly and easily? What if the situation is something that the police cannot do? How can I argue with the courts to give me an order w/o my having to file a complaint?

When you don't know the identity of the defendant, you file suit against "John Doe". This stops the runnning of the statute of limitations on your claim.

Once you have the complaint on record, you will have the power to subpoena whatever discovery you need.

Find the website for the Texas Court. They should provide guidance (on the site) for how to file a complaint.
